Seminar for Elected and Appointed Governmental Officials


A Seminar for Elected and Appointed Governmental Officials was conducted at the Coleman Public Library Friday, June 26. The seminar as co-sponsored by the City of Coleman and Shotts, Pardue, Trevino and Guevara LLP, Attorneys at Law, from Lubbock, Texas. Pictured on the left is Jean Shotts and to his right is Mike Guevarra, attorneys who conducted the workshop. Attendees were from Coleman, Eastland, Santa Anna, Stamford and Cranfills Gap.

Those attending from Coleman were Councilman Harold Skelton, City Manager Larry Weise and City Secretary Sue Burleson.

CITY OF COLEMAN
ORDINANCE NO. 1107

AN ORDINANCE AMENDING CITY ORDINANCE 834 WHICH DECLARES CERTAIN CONDITIONS TO BE A NUISANCE, PROVIDING FOR NOTICE AND HEARING TO ABATE, PROVIDING FOR INVOLUNTARY ABATEMENT BY THE CITY, DECLARING COST OF INVOLUNTARY ABATEMENT AS A LIEN, PROVIDING FOR THE CONTROL AND ABATEMENT OF WEED AND BRUSH GROWTH, FIXING FINES FOR VIOLATION, PROVIDING FOR REPEAL OF PRIOR EXISTING ORDINANCES ON SAME SUBJECT MATTER AND ESTABLISHING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLEMAN:


  • SECTION ONE

    That Section 8.06.002: Illustrative enumeration be amended as follows: The maintaining, using, placing, depositing, leaving or permitting to be or remain on ay public or private property any of the following items, conditions, or actions are hereby declared to be and constitute a nuisance and are therefore prohibited and unlawful; provided, however, this list shall not be deemed or construed to be conclusive, limiting or restrictive:
    1. Grasses in excess of twelve (12) inches, noxious weeds, brush and/or other rank vegetation on tracks of land less than 5 acres including adjacent parkway and alleys.
    1. Accumulation of rubbish, trash, refuse, junk and other abandoned materials, metals, lumber, stagnant water or any object or material that may cause injury, death or disease to human beings.
    1. All disagreeable or obnoxious odors and stenches, as well as the conditions, substances and other causes which give rise to the emission or generation of such odors and stenches including: dense smoke, noxious fumes, gas, soot or cinders, in unreasonable quantities.
    1. All appliances intended for indoor use, working or nonworking, used, stored, abandoned or junked anywhere in the public view.
    2. Fences in a deteriorated condition or subject to falling down due to the lack of maintenance or damage or that are repaired with materials that are not compatible to the original.
    3. Graffiti that is visible from public view or any private property other than on which the same exist.
    4. Excessive accumulation of items intended for use outdoors that are not screened from public view.
    5. Items on a porch, in a yard, under a carport, or within any area visible from the public view that are not intended for use outdoors or not made of material that is resistant to damage or deterioration from exposure to the outdoors.
    6. Furniture intended for indoor use that is used, stored, abandoned or junked outside, including on a porch, in a yard, or under a carport.
    7. Human waste or water that is deposited, stored, discharged or exposed in such a way as to be a potential instrument or medium in disease transmission.
    8. Violations of Chapter 683 of the Texas Transportation Code regarding junked vehicles, and as amended.
    9. Vehicles in the yard of any residence excluding improved parking surfaces, or areas screened from the public view by an opaque fence.
    SECTION TWO

    That Section 8.06.004: Notice to abate: be amended to read:
    Whenever a nuisance is found to exist within the city or within the city's extraterritorial jurisdiction, the Code Enforcement Official or some other duly designated officer of the city shall give ten (10) days written notice to the owner or occupant of the property upon which such nuisance exists or upon the person causing the nuisance. This written notice shall constitute an annual notice for a period of one year from the date of the notice and no further notices shall be required for enforcement.
  • SECTION THREE

    This ordinance shall take effect and be in full force and effect from and after the date of its passage on the second and final reading and is ordained.

CITY OF COLEMAN
ORDINANCE NO. 1106
AN ORDINANCE ALLOWING AND AUTHORIZING THE AMENDING OF CHAPTER 8 (OFFENSES AND NUISANCES), OF THE CITY OF COLEMAN CODE OF ORDINANCES TO READ AS FOLLOWS AND ESTABLISHING AN EFFECTIVE DATE.

Now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLEMAN, TEXAS:


  • SECTION ONE

    That Article 8.01 be added to read: The purpose of this chapter is to protect the public health, safety, environment and general welfare of the citizens of the City of Coleman through the regulation of nuisances and offenses as defined within this chapter.
  • SECTION TWO

    That Section 8.03.001: Chapter 683 Texas Transportation Code Adopted
    Whereas, it is the desire of the City of Coleman, Texas, to prevent the accumulation of abandoned and junked vehicles within the city, to eliminate the health hazards associated with said vehicles and to abate the nuisances attributable to such vehicles, the City of Coleman hereby adopts Chapter 683 of the Texas Transportation Code regarding junked motor vehicles in its entirety herein, as amended, and it shall serve as the city's ordinance for said vehicles. An alternative administrative procedure as outlined in Section 8.03.003 will be used in enforcement.
  • SECTION THREE

    That Section 8.03.002 be amended to read: Definitions
    Abandoned Motor Vehicle. A motor vehicle that:
    1. Has been left unattended on the right of way of a designated city, county, state, or federal highway, street, alley or road for more than forty-eight (48) hours.
    2. be deleted.
      Motor Vehicle: A motor vehicle subject to registration under the laws of the state, except that for the purposes of Section 8.03.003 (a), (b), and (d) of this article, "motor vehicle" includes a motorboat, outboard motor, or watercraft subject to registration under chapter 31, Texas Parks and Wildlife Code.
      Motor Recreational Equipment: Any boat or trailer designed or intended by its manufacturer primarily for the transportation of a boat; and any trailer, semi-trailer or self propelled motor vehicle which is designed, constructed and equipped for human habitation as a dwelling place, living abode or sleeping place either permanently or temporarily.
  • SECTION FOUR

    That Section 8.03.003: ABANDONED MOTOR VEHICLES be amended to read:
    1. Authority to take possession.
      1. The Coleman Police Department may take into custody an abandoned motor vehicle found on public or private property. The police department may employ its own personnel, equipment and facilities or authorize third party operators to provide personnel, equipment and facilities to remove, preserve and store an abandoned motor vehicle taken into custody.
      2. The Coleman Police Department may take into custody any type of trailer or semi-trailer (as defined in Texas law) or any item of mobile recreation equipment (as defined in Section 8.03.002) parked on any public street, alley, sidewalk, highway or public property within the city for a period of forty-eight (48) continuous hours, and the presence of such mobile recreation equipment upon any public street, alley, sidewalk, highway or public property after the expiration of such forty-eight hour period is declared to be a nuisance.
      SECTION FIVE

      That Section 8.03.004: JUNKED VEHICLES be amended to read :
    2. Abatement of Nuisance:
      1. Removal or relocation, by the owner or agent of the owner, of a junk vehicle constituting a public nuisance must result in compliance with all conditions set forth in Article 8.03 of this ordinance. In the event compliance is not achieved, the enforcement process may continue under the original notice issued to the property owner and no further notice is required.
  • SECTION SIX

    This ordinance shall take effect and be in full force and effect from and after the date of its passage on the second and final reading, and is ordained.

    Passed and approved on first reading 4th day of June, 2009.

    Passed and approved on the second and final reading 18th day of June, 2009.

CITY OF COLEMAN


A reminder to all citizens of Coleman that it is illegal to ride any bicycle on the sidewalks within the corporate limits of the city.

Following is the section in the City of Coleman's Code of Ordinances which addresses riding bicycles on the sidewalks of Coleman.

ARTICLE 12.06 BICYCLES

Sec. 12.06.001 Riding on sidewalks
It shall be unlaWful to ride any bicycle on any sidewalk within the corporate limits of the city.

Sec. 12.06.002 Riding after dark
It shall be unlawful to ride or use any bicycle on the streets or alleys within the corporate limits of the city between sundown and dawn unless equipped with front and rear lights.

Sec. 12.06.003 Riders to follow traffic regulations
Any person riding or using a bicycle on the streets of the city shall ride or use same in accordance with the laws, ordinances and regulations governing the driving and use of motor vehicles in the streets and highways.

Sec. 12.06.004 Penalty
Any person found guilty of violating any section of this article shall be fined in accordance with the general penalty provision set forth in section 1.01.009 of this code.

PUBLIC NOTICE

Notice is hereby given that the City of Coleman, Texas will receive bids for the lease of 109.1 acres of land being described as Wm. H. King Survey No. 737 in Coleman County, Texas, Abstract No. 455 located north of FM 568 also known as the McGregor Lease.

Bids must be sealed and in the office of the City Secretary no later than 4:00 p.m. Thursday, August 6, 2009 or the bid will be returned to the bidder un-opened. Bids will be open in regular meeting of the City Council on that same day.

The City of Coleman reserves the right to reject any and all bids or to accept the bid deemed most advantageous to the City of Coleman, Texas.

Notice is hereby given that the City of Coleman, Texas will receive bids for lease of approximately 35 acres of land known as the Landfill Farm Property located adjacent to the City of Coleman Municipal Landfill, for agriculture farming purposes only. Specifications are available at the office of the City Secretary, 200 W. Liveoak St., Coleman, Texas. Bids must be sealed and in the office of the City Secretary no later than 4:00 p.m. Thursday, April 2, 2009 or the bid will be returned to the bidder un-opened.

Bids will be opened that same day during regular Council Meeting. The City of Coleman reserves the right to reject any and all bids or to accept the bid most advantageous to the City of Coleman.

Notice is hereby given that the City of Coleman is requesting proposals for health insurance coverage for its employees. Proposals must be sent to Zesch and Pickett Insurance Administrators, P. O. Box 431, San Angelo, Texas 76902 or contact Bobby Zesch by phone at 1-800-259-7302. Proposals must be sent to Zesch and Pickett prior to March 19, 2009 to be considered. Proposals will be presented at 5:00 p.m. April 2, 2009 during regular Council meeting.

The City of Coleman is making Average Monthly Payment Plan available to its residential customers who are eligible for this service.

To be accepted for the Average Monthly Payment plan, a customer must have and maintain the following:
  1. A satisfactory billing record, meaning no more than two late payments in the previous 12 months.
  2. Reside at the address a minimum of 12 months.
  3. The account paid in full at the time of entering the program.
  4. No cut off notices in the previous 12 months.
  5. Residential Customers only.
The Average Monthly Payment plan will be offered to customers during the months of February and September of each year. Billing will be effective during the months of March and October each year.

If you are currently in the Average Monthly Payment plan it is not necessary to reapply.
